Welcome to Cherish Care. These Terms and Conditions govern your use of our services and website. By using our services or accessing our website, you agree to comply with these terms.
- Services Provided
Cherish Care offers NDIS support and nursing services, including but not limited to personal care, domestic assistance, community access, and specialized nursing support. The services provided are tailored to each client’s NDIS plan and care needs.
- Eligibility for Services
Our services are available to individuals who are registered NDIS participants or private clients requiring nursing support.
An assessment of care needs will be conducted before service commencement.
Clients must provide accurate information about their care requirements.
- Service Agreement
Before receiving services, a Service Agreement must be signed, outlining the type of services provided, frequency, and costs. This agreement is to ensure clarity between Cherish Care and the client regarding responsibilities, rights, and expectations.
- Service Delivery
Services are delivered based on the agreed care plan and schedule.
Changes to scheduled services must be made with at least 24 hours’ notice.
If a service is canceled without appropriate notice, cancellation fees may apply as per the NDIS pricing guidelines.
- Fees and Payment
Cherish Care services are charged in accordance with the NDIS Price Guide or as per agreed private service rates.
Payments for services will be made via the NDIS portal, plan management, or privately, depending on the client’s arrangement.
Invoices are provided for all services, and payments must be made within the agreed period. Late payments may incur additional fees.
- Client Responsibilities
Clients agree to provide Cherish Care staff with a safe working environment.
Clients are responsible for notifying us of any changes to their health, medication, or care requirements.
Any changes to your NDIS plan that affect service delivery must be communicated promptly.
- Privacy and Confidentiality
Cherish Care respects your privacy. All personal information provided to us will be managed in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. Information will only be shared with authorized personnel involved in your care and as required by law.
- Feedback and Complaints
We value your feedback to improve our services. Clients are encouraged to provide feedback or raise any concerns. Complaints will be addressed promptly and in accordance with our complaints resolution process. You may also contact the NDIS Quality and Safeguards Commission if required.
- Limitation of Liability
While Cherish Care strives to provide the highest standard of care, we are not liable for any direct, indirect, or consequential damages resulting from the use of our services, except where required by law.
- Amendments
Cherish Care reserves the right to amend these Terms and Conditions at any time. Changes will be posted on our website, and continued use of our services implies acceptance of the updated terms.
- Termination of Services
Services may be terminated by either party with appropriate notice (usually 14 days unless otherwise agreed). Cherish Care reserves the right to terminate services if clients fail to meet their responsibilities or breach the Service Agreement.
- Governing Law
These Terms and Conditions are governed by the laws of NSW in Australia. Any disputes arising from these terms shall be subject to the jurisdiction of the courts of NSW.
